La Source Platform

These terms of service are concluded between LA SOURCE and any Member.  

ACCESS AND USE OF THE PLATFORM IMPLY FULL ACCEPTANCE BY THE MEMBERS OF THESE TERMS OF SERVICE.

1. Definitions

Capitalized terms used in these terms of service have the meanings set forth in Section 1 of the Membership Agreement and in the section below. When used without capitalization, they have the meaning used in common parlance.

« Application » means the mobile application « The Source » on which the Platform is accessible.

« Membership Agreement » means the contract between THE SOURCE and any person joining the E-Sport Space. » Identifiers » refers to the personal connection identifiers of a Member (login, password) allowing him/her to connect to his/her Member Account on the Platform.

« Site » means the website [Link] on which the Platform is accessible.

2. Purpose and duration

Terms of service govern the conditions of access and use of the Platform as well as the rights and obligations of the Parties in this context.

They apply each time the Member accesses and uses the Platform for the entire duration of its Membership.

3. Description of the Platform

The Platform allows Members to join the E-Sports Area by creating an Account and to

– to deposit Orium on their Kitty;

– to manage their Kitty and to follow their transaction history;

– to pay online for Services and to access them by starting Sessions;

4. The Source’s role as host

Some features of the Platform allow Members to publish content (texts, images, videos, sounds).

THE SOURCE does not exercise any prior control or general supervision over this content.

In this respect, the role of THE SOURCE is that of a host within the meaning of Directive 2000/31/EC of June 8, 2000 on electronic commerce.

Consequently, THE SOURCE shall not be liable in the event of publication of illicit content by a Member.  

THE SOURCE reserves the right, as soon as it becomes aware of it, to withdraw access to illicit information or to make access impossible.

Any Member may notify THE SOURCE of the existence of manifestly illicit content by filling out the form available at the address [Link], in accordance with the provisions of Article 6-I-5 of Law No. 2004-575 of June 21, 2004 for confidence in the digital economy (LCEN).

5. Access to the Platform

5.1 Access and use rights

THE SOURCE grants the Member, for the whole world, a personal, non-exclusive, non-transferable right of remote access and use of the Platform for the duration of the Membership.

These rights are granted solely to enable the Platform to be used by the Member in accordance with its purpose.

5.2 Mode of access

The Member accesses the Platform via the Internet, by logging into his or her Member Account on the Website or on the Application.

11. Intellectual property of The Source

THE SOURCE is and remains the owner of all intellectual property rights on the Platform and on the elements that make it up, whatever their nature, as well as of all the know-how related to it.

The Platform and the elements that make it up are protected by intellectual property laws and other laws, in particular by copyright.

Neither these GCU nor access to the Platform grants any right to the Customer on the Platform or on the elements composing it, other than the right of access and use provided for in article 5.1 of these GCU.

Any use or exploitation of the Platform or of any of its elements in contravention of these GCU may give rise to the exercise of any appropriate action at the initiative of THE SOURCE, in particular the exercise of an infringement action.

These GCU do not in any way authorize the Member to use the trademarks, corporate names, trade names, brand names, domain names and other distinctive signs identifying THE SOURCE, the Platform or the Services in any capacity whatsoever.

12. Protection of databases

THE SOURCE reminds all Members that, in accordance with Directive 96/9 of March 11, 1996 concerning the legal protection of databases and the French Intellectual Property Code, the following is prohibited

the extraction and/or reuse of quantitatively or qualitatively substantial parts of its database;
the repeated and systematic extraction and/or reuse of all or part of its database.

In addition, when the database of THE SOURCE is not protected under the directive 96/9 of March 11, 1996, THE SOURCE contractually restricts the rights of the Members and forbids them any extraction and/or reuse of all or part of the database without its authorization.

The Member is not authorized to use robots, spiders and other technologies whose purpose is to access, read, extract or reproduce the content of the Platform.

In view of the above, any violation of this article may result in civil and/or criminal proceedings in addition to the termination of the Member’s Membership.

13. Personal data

THE SOURCE is required to process personal data concerning Members in the context of the provision of the Platform, as a data controller within the meaning of the RGPD

The information relating to this processing is contained in the Privacy Policy of THE SOURCE made available on the Platform under the following link: [Link to the CP]

Access and use are carried out :

– either from the Member’s computer environment;

In this case, the Member shall be responsible, at his or her own expense, for the acquisition, installation, maintenance and connection of the various elements of the configuration and means of telecommunication necessary for access to the Platform.

– either from LA SOURCE’s IT Environment in the E-Sport Area.

5.3 Member’s Account / Login details

Members access the Platform through their Member Account via their Login details.

The Identifiers are unique, personal and strictly confidential and allow each Member to have his or her own and confidential access to the Platform.

The Customer is solely responsible for :

– for the confidentiality of the Identifiers required to access and use the Solution.

– for his own actions on the Platform and for the way he uses the Platform made available to him.

The Member shall inform THE SOURCE without delay in the event of use or suspected unauthorized use of his Member’s Account or his Identifiers.

6. Availability of the Platform

The Platform is not hosted by THE SOURCE but by a third party provider, a professional host specially chosen for its know-how, its reputation and its commitment to data security.

THE SOURCE remains free to use any other service provider of its choice at any time without this being considered as a modification of the conditions of performance of the GTC.

THE SOURCE shall use its best efforts to offer the Member an availability of the Platform as close as possible to 24 hours a day and 7 days a week.

The Member acknowledges and accepts that this is only an obligation of means for THE SOURCE so that the Platform may be temporarily unavailable at any time of the day.

THE SOURCE draws the Member’s attention to the fact that :

access to or use of the Platform may be interrupted or slowed down for any reason beyond the control of THE SOURCE, in particular in the event of regional or global saturation of the Internet network or of the hosting provider’s server center;
occasional interventions by THE SOURCE for the maintenance of the Platform and the correction of anomalies may result in momentary interruptions of the Platform.

7. Interruption of access to the Platform

THE SOURCE may interrupt access to the Platform without obligation to inform the Members in advance.

8. Suspicious or abnormal use

In case of suspicious or abnormal use of the Platform by the Member, LA SOURCE shall be entitled to suspend all or part of its access to the Platform.

By suspicious or abnormal use, THE SOURCE means in particular :

any failed multiple connection attempt, any activity that is abnormal in relation to the Members’ current or usual activities,
any hacking attempt, any multiple requests sent to the Platform.

9. Evolution of the Platform

THE SOURCE is free to make changes to the Platform without prior notice to the Member.  

THE SOURCE may in particular develop the Platform to adapt to the evolution of technologies and standards used on the Internet network. These changes may require the Member to update his web browser or the Application.

If the Member does not carry out these updates, THE SOURCE cannot be held responsible for any malfunction of the Platform resulting from this and/or any partial or total impossibility to access it.

10. Obligations of the Member

The Member undertakes to use the Platform :

– in a normal, reasonable, non-fraudulent manner and in accordance with its purpose ;

– in compliance with these GCU and all rules of use made available by ENOPTEA, in particular by means of posting, publication or notification on the Platform;

– in compliance with the rights of third parties and THE SOURCE, any regulations in force, public order and good morals.

In particular, the Member shall not:

– distributing, disclosing to the public, copying, reproducing, modifying, creating derivative works, disassembling, decompiling, in particular by reverse engineering, any content or element of the Platform without the express prior written consent of THE SOURCE or, where applicable, that of the third parties concerned;

– to publish false, erroneous, misleading, illicit content or content contrary to public order and morality or links to content with these characteristics via the Platform;

– disrupt or attempt to disrupt the proper functioning of the Platform or the activities taking place on it;

– distribute viruses or other technologies that may harm the activities of THE SOURCE, or the interests of other Members or third parties;

– circumvent robot exclusion protocols or any other measures used to prevent or limit access to the Platform;

– to conduct data mining on the Platform without the express prior written consent of THE SOURCE;

– to use bots, spiders, scrapers or any other automated process to access the Platform for any purpose whatsoever, without the express prior written consent of THE SOURCE;

– to disclose personal data of another Member or of third parties;

– to use the Identifiers of another Member;

– hack or attempt to hack another Member’s Credentials.
